Terms of Service (Binger)

Please read these Terms of Service ("Terms") carefully before using Binger (the "Application" or "Service").

Interpretation and Definitions

Interpretation

Words with the initial letter capitalized have meanings defined below. These definitions apply whether the terms appear in singular or plural.

Definitions

For the purposes of these Terms:

  • Account means a unique account created for You to access the Service or parts of the Service.
  • Affiliate means an entity that controls, is controlled by, or is under common control with a party.
  • Application means the iOS software program provided by the Company, named Binger.
  • App Store means Apple Inc.'s Apple App Store through which the Application is downloaded.
  • Company ("We", "Us", "Our") refers to OR Tech LLC (DBA Binger), 1600 SW 1st Ave, Miami, FL 33129, United States.
  • Content means any information, including ratings, reactions, watchlists, preferences, and search queries, made available by You through the Service.
  • Country refers to the United States.
  • Device means any device that can access the Service.
  • Feedback means suggestions, ideas, or feedback You provide regarding the Service.
  • In-App Purchase means a purchase made through the Application via the App Store.
  • Service refers to the Application and related services provided by Binger.
  • Subscription means a recurring paid plan granting access to certain Service features.
  • Terms means these Terms of Service.
  • Third-Party Services means services provided by third parties, including AI providers, streaming platforms, and data providers.
  • User Content means any content You provide through the Service, including ratings, reactions, watch history, and preferences.
  • You means the individual accessing or using the Service.

Acknowledgment

These Terms govern Your use of the Service and form a legally binding agreement between You and the Company.

By accessing or using the Service, You agree to be bound by these Terms. If You do not agree, You may not use the Service.

You represent that You are at least 13 years old (or the minimum legal age in Your jurisdiction). The Service is not intended for children under this age.

Your use of the Service is also subject to Our Privacy Policy, which describes how We collect and process Personal Data.

Description of the Service

Binger is a personalized movie and TV discovery application that provides:

  • AI-powered recommendations
  • Swipe-based discovery
  • Watchlist management
  • Search and filtering
  • Streaming availability information
  • Optional connection to third-party streaming services

Recommendations are generated algorithmically and are provided for entertainment and informational purposes only.

User Accounts

When creating an Account, You agree to provide accurate and current information and to keep Your credentials secure.

You are responsible for all activity under Your Account and must notify Us immediately of any unauthorized use.

Subscriptions and In-App Purchases

Some features of the Service may require a Subscription or In-App Purchase.

  • Payments are charged to Your App Store account
  • Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
  • You can manage or cancel subscriptions through Your Apple ID settings

All billing, refunds, and subscription management are governed by Apple's App Store terms and policies.

User Content

You retain ownership of Your User Content.

By using the Service, You grant Us a non-exclusive, worldwide, royalty-free license to use, process, analyze, and transmit Your User Content solely to operate, maintain, improve, and personalize the Service, including transmission to Third-Party Services such as AI providers.

You represent and warrant that You have the necessary rights to provide such content and that it does not violate applicable laws or third-party rights.

Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the operation of the Service
  • Scrape, reverse engineer, or misuse the Service or its data

We may suspend or terminate access for violations of these Terms.

Artificial Intelligence and Automated Recommendations

The Service uses automated systems and artificial intelligence to generate personalized recommendations and search results.

By using the Service, You acknowledge and agree that certain User Content and interaction data (such as ratings, reactions, preferences, and search queries) may be transmitted to and processed by third-party artificial intelligence services, including the OpenAI API and similar providers, as reasonably necessary to operate, maintain, and improve the Service.

You authorize Us to share such data with AI service providers solely for these purposes. These third-party services operate under their own terms of service and privacy policies, and We do not control their internal data practices.

The availability, functionality, and quality of certain features of the Service may depend on these third-party AI services.

Third-Party Services

Streaming Service Connections (via Younify)

If You choose to connect streaming services through the Service, Binger uses Younify to facilitate access to viewing activity and related data made available by those providers.

Your use of this functionality is also subject to Younify's own policies:

By connecting streaming services, You acknowledge and agree that Younify's processing of data is governed by its own policies and that Binger is not responsible for Younify's services or practices.

Other Third-Party Services

The Service also integrates third-party content and data providers such as TMDB, as well as third-party AI services. We do not guarantee the accuracy, availability, or completeness of third-party content or services.

Privacy and Data Processing

Your use of the Service is governed by Our Privacy Policy. By using the Service, You consent to the collection, use, transmission, and processing of data as described in the Privacy Policy.

Anonymized and Aggregated Data

The Company may generate and use anonymized and aggregated data derived from use of the Service, including usage patterns and viewing trends.

Such data does not identify individual users and is not considered Personal Data. The Company may use and share this anonymized or aggregated data for lawful business purposes, including analytics, research, and service improvement.

Feedback

If You submit Feedback, You grant Us a worldwide, perpetual, irrevocable, royalty-free license to use it for any lawful purpose without compensation.

Termination and Account Deletion

You may stop using the Service at any time.

You may request deletion of Your Account by contacting contact@binger.ai. Upon verification, We will initiate deletion of Your Account and associated data, subject to legal and operational retention requirements.

We may suspend or terminate Your access to the Service if You violate these Terms or if required by law.

Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, to the maximum extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, We shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to Your use of the Service.

Our total liability shall not exceed the amount paid by You, if any, in the twelve (12) months preceding the claim.

App Store Compliance

These Terms are between You and the Company, not Apple. Apple is not responsible for the Application or its content.

If these Terms conflict with Apple's terms, Apple's terms shall prevail.

Governing Law

These Terms are governed by the laws of the State of Florida, excluding conflict-of-law principles.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
